Abstract

This text analyzes aspects of the Corporate Liability Bill for economic infractions, recently considered and rejected by the German Parliament, highlighting the adoption of the mandatory prosecution principle, as well as the effects on the sanction’s quantification, arising from the existence of a valid and effective compliance program.
