Abstract

Abstract: The scope of this article is to evaluate police testimonies against the pertinent procedural guarantees within the Brazilian legal system, considering the potential accusatory tactics aimed at transforming such testimonies into sole pieces of evidence, thereby resulting in violations of the prohibition provided for in Article 155 of the Brazilian Criminal Procedure Code. Therefore, it is necessary to comprehend the procedural guarantees granted to the defendant, which can often be disrespected, culminating in the issue known as epistemic injustice arising from the disproportionate allocation of credibility between the parties in the legal process. To this end, reflections rooted in the field of philosophy and in Súmula 70 of the Court of Justice of the State of Rio de Janeiro will be conducted, followed by a detailed analysis of Interlocutory Appeal in a Special n.º 1.936.393/RJ and Special Appeal n.º 2037491/SP, both judged by the Superior Court of Justice.
