Abstract

This article addresses the relevance of Comparative Criminal Law in today's world, presenting its main characteristics, as well as its use for understanding both domestic Criminal Law and International Criminal Law, in addition to the challenges involving language barriers, the different methodologies of the Common Law and Civil Law systems for scientific construction, the regional, cultural and historical differences that explain the differentiated solutions to criminal issues, such as the analogical integration to the defendant's disadvantage, the criminal attempted liability and the discussion on dolus eventualis, conscious negligence, and recklessness.
