Abstract

The analysis of improper omissive offenses represents a challenge in any legal system, generating debates among the most renowned jurists. With the exponential increase in data creation and processing, technological changes occur at a rapid pace, raising crucial questions about the criminal responsibility of those who launch Artificial Intelligence Technologies (AI) to the general public. In this context, corporate criminal law faces complex challenges, as it needs to integrate several areas to find effective solutions to an increasingly common problem in the last ten years. Divergent opinions already serve as the basis for new legal interpretations, highlighting the importance of the mastery of new technologies, the understanding of work chains and the adoption of good practices criteria in the use of AI.
