O regime de cumprimento da sanção nos acordos de colaboração premiada: uma análise teleológica, holística e garantista do art. 4º, §7ª da lei n. 12.850/2013

Abstract

This article aims to analyze the incidence of art. 4, § 7, item II, of law nº 12.850/2013, with the wording established by law n. 13,964/2019, in particular the possibility of setting, in an award-winning collaboration agreement, a sanctioning compliance regime, different from that provided for by law, provided that it is more favorable to the employee. To this end, a systematic approach to the legal provision will be carried out, always seeking an interpretation of the aforementioned provision in the way that best favors the collaborator, under a guaranteeing vision, and is in line with the other normative provisions contained in the legal system, as well as being of according to the awarding objectives of the awarded collaboration institute.
